Promotion of human trafficking; sexual trafficking of a minor; human trafficking Crime & Punishment in Indiana :

STATUTORY

- If an offender who is at least 18 knowingly or intentionally sells or transfers custody of a child less than 16 for the purpose of participating in sexual conduct.
- If an offender who is at least 18 knowingly or intentionally sells or transfers custody of a child less than 16 for the purpose of prostitution.

A maximum of 30 years in prison; up to a $10,000 fine

Class B felony
|
- If offender knowingly or intentionally recruits, harbors, or transports a child less than 16 with the intent of inducing or causing the child to participate in sexual conduct.
- If offender knowingly or intentionally recruits, harbors, or transports a child less than 16 with the intent of inducing or causing the child to engage in prostitution.
- If offender, by force, threat of force, or fraud, knowingly or intentionally recruits, harbors or transports another person to force the other person into participating in sexual conduct.
- If offender, by force, threat of force, or fraud, knowingly or intentionally recruits, harbors or transports another person to force the other person into prostitution.
- If offender, by force, threat of force, or fraud, knowingly or intentionally recruits, harbors or transports another person to force the other person into marriage.

Class C felony
|
- If offender knowingly or intentionally agrees to pay money or other property to another person for an individual who the offender knows has been forced into prostitution.
- If offender knowingly or intentionally offers to pay another person for an individual who the offender knows has been forced into prostitution.
- If offender knowingly or intentionally pays to another person for an individual who the offender knows has been forced into prostitution.

Indiana law allows promotion of human trafficking; sexual trafficking of a minor; human trafficking to be enforced as a statutory charge. This means that this charge can be applied to cases in which the victim is younger than the Indiana Age of Consent, even if the victim willingly engages in sexual relations with the defendant.
Promotion of human trafficking; sexual trafficking of a minor; human trafficking is a charge that is unique to Indiana. Crimes that would be prosecuted as promotion of human trafficking; sexual trafficking of a minor; human trafficking in Indiana will be prosecuted under a different statute depending on the state in which the crime takes place.
