- If the act is between persons who are not at the time cohabitating as husband and the victim is 14 or 15 and the act is performed while the victim is physically helpless.
- If the act is between persons who are not at the time cohabitating as husband and the victim is 14 or 15 and the act is performed while the victim is under the influence of a controlled substance.
- If the act is between persons who are not at the time cohabitating as husband and the victim is 14 or 15 and the offender is 4 or more years older than the victim.
- If the act is between persons who are not at the time cohabitating as husband and the victim is 14 or 15 and the offender is in a position of authority over the victim and uses that authority to coerce the victim to submit.
- If the act is between persons who are not at the time cohabitating as husband and the victim is 14 or 15 and the offender is related to the victim by affinity to the fourth degree.
- If the act is between persons who are not at the time cohabitating as husband and the victim is 14 or 15 and the offender is related to the victim by blood.
