- A person commits aggravated sexual abuse in the third degree when the offender, outside of a valid medical purpose, inserts a foreign object into another’s vagina, urethra, penis, rectum, or anus, causing physical injury to such person, and the person is incapable of consent due to mental disability or mental incapacity.
- A person commits aggravated sexual abuse in the third degree when the offender, outside of a valid medical purpose, inserts a foreign object into another’s vagina, urethra, penis, rectum, or anus when the victim is less than 11 years old.
- A person commits aggravated sexual abuse in the third degree when the offender, outside of a valid medical purpose, inserts a foreign object into another’s vagina, urethra, penis, rectum, or anus when the victim is physically helpless.
- A person commits aggravated sexual abuse in the third degree when the offender, outside of a valid medical purpose, inserts a foreign object into another’s vagina, urethra, penis, rectum, or anus by forcible compulsion.
