Gross sexual imposition Crime & Punishment in North Dakota :
The North Dakota code § 12.1-20-03 defines two degrees of the crime gross sexual imposition, each with associated punishments. The degree of the crime depends on the specifics of the crime committed, with higher degrees of the charge generally receiving harsher punishments.

- A person who engages in a sexual act with another, or who causes another to engage in a sexual act, is guilty of an offense if the offender knows or has reasonable cause to believe that the other person suffers from a mental disease or defect.
- A person who engages in a sexual act with another, or who causes another to engage in a sexual act, is guilty of an offense if the victim is less than fifteen years old.
- A person who engages in a sexual act with another, or who causes another to engage in a sexual act, is guilty of an offense if that person knows or has reasonable cause to believe that the victim is unaware that a sexual act is being committed upon him or her.
- A person who engages in a sexual act with another, or who causes another to engage in a sexual act, is guilty of an offense if that person or someone with that person’s knowledge has substantially impaired the victim’s power by administering or employing without the victim’s knowledge intoxicants, a controlled substance.
- A person who engages in a sexual act with another, or who causes another to engage in a sexual act, is guilty of an offense if that person compels the victim to submit by force or by threat of imminent death, serious bodily injury, or kidnapping, to be inflicted on any human being.

- A person who engages in a sexual act with another, or who causes another to engage in a sexual act, is guilty of an offense if as a result of injuries sustained during the course of an offense under this section, victim dies.
- A person who engages in a sexual act with another, or who causes another to engage in a sexual act, is guilty of an offense if the offender engages in a sexual act with a victim under 15, and offender is at least 22 years of age
- A person who engages in a sexual act with another, or who causes another to engage in a sexual act, is guilty of an offense if the offender compels victim to submit to a sexual act by force or by threat of imminent death, serious bodily injury, or kidnapping, to be inflicted on any human being.
- A person who engages in a sexual act with another, or who causes another to engage in a sexual act, is guilty of an offense if the offender inflicts serious bodily injury upon victim.
